The addition arrives as ex parte reexamination has become one of the more active tools in patent strategy. [FLAG , clear before publish] According to Juristat’s analysis of USPTO records, ex parte reexamination has overtaken inter partes review as the leading post-grant validity tool for the first time since the America Invents Act, with filings up 53 percent year over year in 2025 and on pace for roughly 870 in 2026.

An issued patent has never told anyone whether its claims would hold up if tested.
