Tulip Battery Licensing Program Brings US ITC Action Against EVE Energy

BUDAPEST, JULY 22, 2026: LG Energy Solution, a founding member of Tulip battery licensing program, has brought legal proceedings before the United States International Trade Commission (ITC) alleging that EVE Energy lithium-ion battery products infringe certain LG Energy Solution patents in the Tulip portfolio.  The asserted patents cover tabless cell technology, separator technology, and cell safety features, which have been critical in enabling increased performance in power applications while maintaining safety.  This action seeks to address extensive infringement in the U.S. power tool market, which has widely adopted these patented cell technologies.

The ITC action is directed at EVE Energy as a battery manufacturer integrating the relevant cell technologies as well as power tool customers that source cells from such unlicensed supplier and import them in the U.S. market.  Quinn Emanuel Urquhart and Sullivan, LLP represents LG Energy Solution and Tulip in this matter.

The new ITC case is a continuation of active enforcement efforts within Tulip’s battery licensing program, which recently resulted in a patent license agreement with Sunwoda Electronic that resolved pending Tulip actions in Germany and Korea.

“Tulip has worked closely with LG Energy Solution to initiate this action before the ITC seeking the exclusion of infringing battery products” noted Giustino de Sanctis, Chairman of the Tulip group, adding that “the prompt filing of new enforcement proceedings demonstrates the commitment of the Tulip program to addressing the proliferation of unlicensed lithium-ion battery products across various industries and preserving fair and competitive market conditions.”
