Trailblazer & Troublemaker: The Extraordinary Life Story of Judge Pauline Newman

This week on IPWatchdog Unleashed, I took a backseat and played the role of producer, not host. In a spirited discussion at our annual Women’s IP Forum, attendees were treated to an insightful fireside-style chat conversation with the Honorable Judge Pauline Newman, a trailblazer for women in law and a luminary in the field of intellectual property. Judge Newman spoke with Renee C. Quinn, Chief Operating Officer of IPWatchdog, Inc., about her extraordinary career and her life journey. It is this conversation between Judge Newman and Renee that is our episode this week.

Judge Pauline Newman has served with distinction on the U.S. Court of Appeals for the Federal Circuit since her appointment by President Ronald Reagan in 1984. Her career has been marked by a commitment to innovation and the advancement of strong intellectual property rights, shaping the very foundation of modern patent law. But did you know that Judge Newman was until a few years ago an active and licensed pilot? Did you know that she tutored singer and songwriting legend Joan Baez in chemistry when Baez was in high school? While so much of Judge Newman’s life has been well documented, there are so many layers to the extraordinary life of Judge Pauline Newman.

Judge Newman provides her thoughts on life, patriotism, coming of age during World War II, the law, whether she ever experienced imposter syndrome as she climbed to the highest echelon of the male dominated worlds of innovation and intellectual property, and much more.

An Adventurous Life

Judge Newman’s life story reads like a novel. During World War II, while in High School, she learned to fly airplanes. At the time women pilots were already ferrying bombers across the Atlantic, and everyone was learning skills that could be useful to support the war effort.

She also served with UNESCO, helping underdeveloped nations with industrialization. And it was while she was working with UNESCO that she met Al Baez, the father of world famous singer and songwriter, Joan Baez. At the time Joan was in high school and struggled with chemistry. Her father asked Newman if she would tutor her, which she did.  During Joan’s summer vacation and over weekends the pair met for tutoring sessions. “I was tutoring her and reading chemical formulas, she would put them to music,” Newman remembered.

Breaking Barriers in Law and IP

While seeking new challenges in the chemical industry, she found herself at NYU Law School, crafting patent applications—a profession not initially seen as desirable for scientists or lawyers. Yet, Newman saw possibilities others overlooked, which eventually lead her to work to bring uniformity to patent law through the establishment of  the Federal Circuit—a court formed to bring expertise and consistency to patent law, and the court on which she is still a member more than 40 years after her appointment by President Ronald Reagan.

Perhaps one of the most interesting things to arise during this conversation related to a question from the audience about whether Judge Newman had ever experienced imposter syndrome. Quite telling, Judge Newman did not even know what imposter syndrome was. After a basic definition was provided—when you think you are not good enough even though by all indications you have the right credentials—Renee to quipped: “I have a suspicion the answer is no!”

“I’d like to find an example because I think the true answer is I never had time to think about it. I had always, for one reason or another, or no reason, taken on more than I had time to handle. That didn’t slow me down,” Judge Newman explained as she attempted to answer the question about whether she had ever experienced imposter syndrome. “I don’t remember ever being troubled by that concept,” she concluded. Eye-opening indeed. She was always so busy, so focused, and always such a high achiever she didn’t have time to even contemplate the idea that she might not be good enough.

Reflecting on the State of Innovation

Throughout the discussion, Judge Newman emphasized the importance of not being complacent. She highlighted that significant change often requires proactive effort: “It’s not so hard to make changes that need to be done.” Her advice resonates deeply—whether in law, technology, or personal pursuits, the courage to drive change and improve situations can lead to significant advancements.

Challenges and Opportunities for Modern Innovators

Judge Newman expressed concerns about the current state of innovation law, particularly the uncertainties she perceives in the U.S. patent system. She noted that these uncertainties could affect research investments and technological advancement. Her suggestion to possibly return patent jurisdiction to regional circuits reflects her continuous dedication to optimizing the legal framework to better serve innovators.

A Legacy of Trouble-making for Good

Judge Pauline Newman’s storied career and steadfast commitment to making a difference offer invaluable lessons. Her life as a so-called “troublemaker for good” has been marked by relentless pursuit of improvement and a willingness to challenge the status quo, making her a revered figure and a source of inspiration. Her parting advice to the audience was simple: embrace the role of a change-maker, because sometimes, troublemakers indeed pave the way for progress.

Indeed, Judge Pauline Newman’s insights and experiences, drawn upon from a prosperous and consequential career, call us to action, urging us to recognize our potential to drive meaningful change and to embrace opportunities for improvement in the fields we are passionate about. Her legacy is a testament to the power of perseverance and leave a lasting impact on the world of intellectual property and beyond.
