September 20, 2024 10:54 amUnderstand who can be sued or who you think can be sued under a given claim (manufacturer, user, importer, foreign exporter, component manufacturer, someone who practices step as part of a method claim, etc., someone who produces overseas a product using U.S.-patented method and sells into the U.S., etc.) and draft accordingly. That means as clearly as possible with the intended/potential competitor (i.e., target) in mind.
There are practitioners who confuse “ambiguity” or “lack of clarity” with “broad scope of protection.” I see the article as consistent with that “camp.”
I respectfully disagree with the notion that you should submit claims that stand a better than 50% chance of being rejected by an examiner who knows what they are doing.
