The Air Force Civilian Service (AFCS) is looking for a Patent Attorney (NH-1222-04) to join the team at the Air Force Materiel Command Law Office at Wright-Patterson AFB, Dayton, OH. The primary purpose of this position is to provide Intellectual Property legal services including preparing and prosecuting patent applications; advising Air Force employees on rights in inventions, patents, and other intellectual property; and legal reviews of instruments for the transfer of Air Force technology.

Duties and Responsibilities:

  • Provides highly specialized legal advice and counsel across the Air Force, including to the Air Force Material Command Commander (AFMC/CC), Headquarters Air Force Material Command (HQ AFMC) Command Counsel, Air Force Life Cycle Management Center Commander (AFLCMC/CC), Air Force Research Laboratory Commander (AFRL/CC), Air Force Material Command Law Office (AFMCLO) Director, Air Force Material Command Law Office (AFMCLO/JAZ) Division Chief, and other senior leaders and their staff on extremely complex patent prosecution and related intellectual property matters.
  • Establishes, develops, and maintains effective working relationships with the U.S. Patent and Trademark Office (USPTO), Department of Justice, Air Force Office of the General Counsel, Defense Technology Security Administration, Air Force Research Laboratory, and other organizations related to inventions and research or collaboration agreements.
  • Advises and assists laboratories, centers, and other organizations on intellectual property, patent prosecution, and technical data issues arising under contracts, grants, cooperative agreements, other transactions, cooperative research and development agreements, and other technology transfer (T2) agreements.
  • Is a recognized expert responsible for the timely and independent negotiation, preparation, filing, and prosecution of legal instruments and documents, including: patent applications; patent interference proceedings; infringement investigations; patent appeals; T2 and related agreements; Invention Secrecy Act (ISA) orders and related applications; and patent, trademark, copyright, and technical data agreements and claims.
  • Provides legal determinations, opinions, briefings, guidance, and commentary on issues that relate to these functions, as well as any intellectual property related legislation, by communicating effectively with the AFMC Commander, HQ AFMC Command Counsel, AFLCMC/CC, AFRL/CC, AFMCLO Director, AFMCLO/JAZ Division Chief, Air Force Office of the General Counsel, other federal laboratories, state and local governments, educational institutions, non-profit organizations, private industry, and other high ranking military and civilian officials.

Knowlege, Skills, and Abilities (KSA’s):

  • Knowledge of engineering, mathematics, or science obtained by graduation from an accredited college or university with a preferred undergraduate degree in electrical engineering.
  • Expert knowledge and skill in patent preparation and prosecution, including prior art searching, scientific, and legal research, interviewing inventors and examiners, and U.S. Patent & Trademark Office practice and procedure.
  • Expert knowledge and skill in Technology Transfer law and practice, including preparation and negotiation of Technology Transfer agreements.

Qualifications and Additional Work Requirements:

  • US Citizenship is required.
  • This position will require random drug testing and the candidate will be subject to passing a drug test upon selection.
  • Must be currently licensed as an attorney and counselor-at-law in a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.
  • Must be currently registered to practice as an attorney with the U.S. Patent & Trademark Office and admission to the patent bar.
  • Employee must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth.
  • Employee may be required to file an Office of Government Ethics (OGE) Form 450, Confidential Financial Disclosure Report, upon appointment and annually thereafter.
  • Incumbent is required to obtain and maintain the appropriate security and program clearance necessary to execute the duties of this position.
  • Incumbent is required to maintain Continuing Legal Education (CLE) currency as established by incumbent’s bar.
    Copy of Patent License is required for consideration.
