Resolution Without Surrender: What Really Triggers Settlement of IP Disputes

View Session Speakers

Most IP disputes do not end with a verdict—they end with a deal. Yet settlements rarely occur because one side suddenly “changes its mind.” They happen when risk, cost, timing, and leverage finally align. Understanding what actually drives resolution is critical for parties who want outcomes that protect value rather than surrender it.

This panel examines the real factors that trigger settlement in IP disputes across patents, trade secrets, trademarks, and technology contracts. Panelists will explore how litigation milestones, procedural rulings, parallel proceedings, business pressures, and market realities reshape bargaining power over time. The discussion will cut through formal negotiation theory and focus on how and when disputes are resolved in practice.

The conversation will also address how early strategy decisions—venue selection, claim scope, portfolio framing, and enforcement posture—determine whether resolution is achievable and on what terms. Panelists will examine the role of damages models, injunction risk, PTAB exposure, insurance, and third-party funding in accelerating or delaying settlement.

This session is designed for litigators, in-house counsel, and business leaders who want to resolve disputes without capitulating—and who understand that effective settlement strategy begins long before negotiations start.
