Using Trademarks, Trade Dress and Design Patents to Fight Knockoffs and Counterfeits

Counterfeit products and knockoffs are an enormous problems for businesses all over the world, from consumer goods, to software, to pharmaceuticals, counterfeits have become nearly ubiquitous. Counterfeits and knockoffs easily (and conservatively) cost brand owners many hundreds of billions of dollars each year. Given the low risk of getting caught, high profit margins and often lackluster and uncoordinated enforcement regimes, the brand owner fight is an ever-growing challenge, particularly for those selling through online platforms, which can often be overrun with both counterfeits and knockoffs. This panel will discuss the difference between counterfeits and knockoffs, the sophistication of international counterfeit and knockoff operations, and distribution of these fake, often unsafe products through online marketplaces and social media sites. Panelists will address the “whack-a-mole” nature of monitoring and enforcement that must be performed, and ways to prioritize for the biggest impact.
