Once upon a time it would have been heresy to recommend that a high-tech startup move forward with few, or no, patents or patent applications. How times have changed! A recent study found that 30% of US Unicorns (i.e., startups with valuations of over $1 Billion) have no patent assets at all, while over 60% have 10 or fewer patent assets (i.e., issued patents plus pending applications). Furthermore, startups often strive for an exit based on their original business plan, while forgoing low hanging IP monetization opportunities – such as non-core licensing – to the detriment of their investors.
