The Future of Patent Dealmaking, Monetization and Licensing *

As the result of patent skepticism among policy makers and jurists in the United States the value of U.S. patents has continued to decrease, as have monetization opportunities associated with U.S. patents and portfolios. Meanwhile, many countries and Europe have joined together to create a unitary patent and an associated Unified Patent Court, which so far has been viewed as patent owner friendly thanks to the availability of preliminary and permanent injunctive relief. Similarly, Germany, Brazil and other countries around the globe have become venues more friendly to patent owners than the United States. As a result, industry professionals continue to take fresh looks at foreign markets, foreign patent portfolios and foreign strategies.

This panel will discuss the current global marketplace for both dealmaking and enforcement, what the future looks like, and provide an overall assessment of the state of the global IP monetization and dealmaking within the industry.
