From Molecule to Medicine: How Biopharmaceutical Innovation Actually Happens
Public debates about pharmaceutical patents often assume that the principal act of innovation is discovering or identifying a new active ingredient, and what follows is little more than routine execution. The reality of developing a medicine is considerably more complicated. Identifying a promising molecule is only the beginning of a very long process that will require years of additional research to determine how to formulate it, make it bioavailable in vivo, deliver and dose it effectively, manufacture it reliably at commercial scale, improve safety and efficacy, identify responsive patient populations, and discover new therapeutic uses. Solutions to these problems may emerge at different stages of development and may themselves represent important innovations—sometimes more groundbreaking than the original innovation or discovery.
Rather than begin with patent doctrine or policy, this panel will start with the underlying scientific, clinical and regulatory realities of bringing a medicine from discovery to patients. Panelists will examine how innovation unfolds throughout the development lifecycle, why meaningful inventions frequently occur years after the initial discovery, and why those inventions can naturally result in later-filed patents, continuations and layered patent portfolios. By establishing how biopharmaceutical innovation actually occurs, the discussion will provide a fact-based framework for honestly evaluating criticisms of so-called “evergreening” and “patent thickets,” as well as the broader debates over patent incentives and other policies necessary to support continued medical innovation.
