101 in the District Courts: What is Happening with Alice? *
Ten years ago the United States Supreme Court issued its landmark decision in Alice v. CLS Bank, which applied the Mayo patent eligibility framework to software. Rather than rehash the relative merits of whether the Supreme Court should have so changed the law, or whether the Federal Circuit has faithfully followed Supreme Court guidance, or whether Congress will or should enact a legislative fix to 101, this panel will explore how district courts are actually handling cases where software patents are litigated and district courts are asked to invalidate claims because they lack eligibility under the Alice decisional framework. In addition to discussing the wide differences between how district courts handle and interpret 101, the panel will also discuss the latest Federal Circuit precedent and trends, and how the latest pronouncements and trends at the Federal Circuit are influencing district courts.
