Webinar: UPC Issues First Final Permanent SEP Injunction – Impact and Ramifications of Philips v. Belkin

On October 3rd, the UPC Court of Appeal handed down the court’s first final judgment on the merits in re Philips vs Belkin. This UPC decision marks UPC history and is a true milestone for many reasons. First and foremost, it is the first injunction handed down by the UPC Court of Appeals on the merits. Second, the decision clarifies important aspects of liability for patent infringement before the UPC, such as directors’ liability, claims for destruction and recall, and penalty payments for being in contempt of court. Last but not least, this ruling is of great interest due to its interplay with parallel national patent litigation.
