PTAB Winning Strategies for Owners and Petitioners**
Unlike most district court judges, the Administrative Patent Judges (APJs) that make up the Patent Trial and Appeal Board (PTAB) are technically savvy engineers and scientists, many with advanced degrees and many years of industry experience. As a result, what works in district court or on appeal to the Federal Circuit often does not work while appearing at the PTAB, and frequently can backfire.
This panel will discuss best practices and tips for winning at the PTAB, whether you are on the side of the petitioner or patent owner. Specific discussion will focus on the framing of arguments, preliminary responses and rebuttals, selection of experts, how best to use experts and declarations, choosing and presentation of the most persuasive arguments, and more.
