Building Transaction-Ready Patents: Quality, Structure, and Strategic Fit *
Patent portfolios do not fail because companies lack innovation—they fail because the assets themselves are not built to perform. Too often, patent development is treated as a procedural exercise rather than a capital investment, resulting in assets that cannot withstand scrutiny or deliver meaningful leverage. But the reality is simple: if the assets are not built correctly, the portfolio will not perform—regardless of size.
This panel focuses on how to build patents that are transaction-ready from inception. Panelists will examine how to align patent development with real-world business considerations, including where products are made and sold, where competitors operate, and where enforcement is viable. The discussion will address how undisciplined filing strategies, jurisdictional sprawl, and continuation drift inflate costs without increasing value.
The conversation will then turn to asset quality. In today’s environment, patents are evaluated like financial instruments—assessed for technical relevance, enforceability, and connection to identifiable revenue streams. Panelists will discuss how to draft and prosecute patents that can withstand diligence, including building specifications that support durable claim scope, structuring continuation strategies to preserve flexibility, and avoiding prosecution pitfalls that can undermine future enforcement or valuation.
