CLEOn February 17, 2023, Germany ratified the Agreement on the Unified Patent Court. The Unified Patent Court (UPC) began on June 1, 2023. The driving force behind the UPC is to make patent enforcement in Europe more efficient, by allowing patent owners to bring an infringement action in a single place rather than 17 different jurisdictions.

With so much uncertainty about patent eligibility and patent validity in the United States, the unitary patent and Unified Patent Court combination has the ingredients to make Europe the crossroads of technology. Indeed, the founding fathers of the UPC have done an excellent job by establishing a court system that is able to efficiently and timely deal with patent disputes. This system is operated by the best-in-class judges who will put their personal stamp on the system and will proactively shape it in the upcoming years.

This panel will discuss the intricacies and nuances of the UPC system, with particular comparison to the German system and how patents are litigated in the United States. Panelists will discuss the structure of UPC, its effectiveness in lowering fees, potential for forum shopping by litigants, how evidence is gathered, potential for parallel issues being litigated at UPC and other EP courts, selecting technical judges, major decisions lawyers should know and more.
