Turning Patents into Revenue: Building Successful Enforcement-Driven Monetization Campaigns *
Patent monetization does not begin with a demand letter, and it does not succeed merely because a patent owner believes its assets are valuable. Successful monetization depends on credibility: credible patents, credible evidence, credible infringement theories, credible damages, and the credible prospect that the patent owner is prepared to litigate if a business resolution cannot be reached.
This panel assumes the foundational portfolio work has already been completed. The patents have been identified, organized, analyzed, and prioritized. The discussion will focus on what comes next, which is how patent owners convert prepared assets into licensing and enforcement campaigns capable of generating real revenue.
A central theme of our discussion will be that while early-stage licensing resolutions are possible, they are rarely achieved through generalized assertions of value. Reaching a favorable resolution for a patent owner typically requires a well-developed enforcement strategy that demonstrates technical relevance, litigation readiness, and the ability to proceed if negotiations fail.
Panelists will examine the core components of an enforcement-driven monetization strategy, including target selection, evidence of use, claim mapping, infringement reads, damages narratives, licensing presentations, and portfolio positioning. The discussion will also address how patent owners can build a monetization thesis that withstands scrutiny from operating companies, outside litigation counsel, investors, and litigation finance providers. Finally, panelists will also discuss how preparation affects timing, negotiating leverage, settlement dynamics, and overall campaign outcomes.
