Protecting Fintech IP: Designing and Implementing an Optimal Strategy

FinTech covers many different types of technologies and has become a catch-all term referring to the use of various technologies that collectively empower financial transactions. Fintech encompasses complex blockchain innovations, cybersecurity and encryption technologies, payment gateways, artificial intelligence (AI), and cryptocurrencies and trading platforms. While it has become challenging—if not impossible— to patent financial business methods and payment gateways, it is certainly possible to patent blockchain innovations, cybersecurity and encryption related inventions, and AI tools.

This panel will first begin with a discussion of what is fintech, and move to explore fintech from various angles, discussing designing and implementing strategies for the robust protection of fintech intellectual property and intangible assets.

Among other things, the panel will address:

(1) Which products should you focus on, especially with limited resources?
(2) How to identify the the core innovations within a product to invest in?
(3) How to get product teams to capture alternative embodiments?
(4) How to get product teams to prioritize patenting during a busy product development cycle?
(5) How to “predict” what competitors will build to compete with your product?>
(6) The importance of design patents for software and fintech products.
(7) Filing strategy (track one v. standard, foreign filing, IDS management).
(8) Communicating 101/112 issues to product teams to streamline the patent protection strategy.
(9) Quality vs. Quantity.
