Patent Litigation in Europe: The Unitary Patent Court Begins *
On February 17, 2023, Germany ratified the Agreement on the Unified Patent Court. This means that the Unified Patent Court (UPC) will definitely go live on June 1, 2023. By the time we hold IPWatchdog LIVE 2023, we will have three months of information to review to see whether predictions about how this new court system would operate are proving to be correct. This panel will discuss the UPC system and structure, the judges and their incentives, available remedies which include a European-wide injunction, for which companies the UPC will make sense, and much more.
