The Infringing Underbelly of AI – Is Resistance Futile?
In a rapidly evolving field that seems to be getting deeper daily, AI is transforming how we create, and how we protect, art, intellectual property, brands, and even identities. Deep fakes, used to create highly realistic but false representations of people and events, can be used to create infringing images, fake logos, endorsements, advertisements, or other content that is deceptive to consumers and damaging to a brand’s reputation. Can we harness the power of these tools for the greater good while simultaneously navigating the legal and ethical challenges that come with such powerful evolution in technology?
The legal and ethical implications of deep fakes in the context of IP rights enforcement run deep. Are current laws and regulations equipped to deal with deep fakes? The need for new legal frameworks to address this emerging issue is real – the potential impact of deep fakes on the accuracy and reliability of evidence in IP disputes, as well as the potential for AI and deep fakes to be used as a tool both to violate, and to enforce, IP rights, expose the limitations of the current legal framework.
