USPTO Director Lee sued for declaring federal holiday, allowing IPR filing after statutory deadline

It was only going to be a matter of time before Director Lee declaring a federal holiday without any statutory authority came back to haunt the USPTO. Here the defendants were served with the complaint on December 24, 2014, which means any IPR had to be filed on or before Thursday, December 24, 2015. The defendants filed their IPR petitions on Monday, December 28, 2015. The patent owner argues in a recently filed federal complaint that the IPR petitions would be considered untimely but for Director Lee declaring December 22-24, 2015, federal holidays due to the catastrophic failure of the USPTO’s electronic filing systems.

Apple May Ultimately Regret its Success in Apple v. Samsung

With over 205 billion in cash reserves at last count, Apple certainly doesn’t “need” the full nine-figure damage award. And, unless Congress steps in and amends the damage award statute, Apple will likely find itself defending its “total profits” for devices even where accused of infringing minor design features. Given the current statutory language the Supreme Court could very well agree with the Federal Circuit and find that it is bound by the clear statutory language. Clearly it is time for Congress to step in and amend Section 289, possibly to add apportionment.

Automakers own most vehicle infotainment patents despite gains by Android Auto, Apple CarPlay

Autonomous self-driving technologies may be grabbing headlines for vehicle manufacturers but it’s hardly the only direction in which carmakers are innovating. Infotainment systems bring a smartphone-like platform for software applications straight to the dashboard, providing everything from navigation assistance to streaming music services and even phone call capabilities. Knob-based radio and air conditioning controls are being replaced by touch-sensitive displays and voice-controlled services connecting drivers and passengers to Internet-based services. According to market research reports, the market for in-car infotainment systems is expected to rise from $14.4 billion in 2016 up to $35.2 billion in 2020.

Technology Startups: The Game-changers of Virtual and Augmented Reality

With the advent of enhancements in audio-video technology, Virtual-Reality (VR) has taken the world by storm. While VR has been enjoying most of the limelight, another similar technology – Augmented Reality (AR) is catching up fast. The patent landscape of VR is dominated by Sony followed by IBM, Samsung and Microsoft when it comes to total number of patented inventions. Samsung patent totals top 2,000 in Q1 2016, invents foldable and rollable electronic display screens

In 2015, Samsung Electronics earned a total of 5,072 patents from the U.S. Patent and Trademark Office, a slight increase from the 4,936 U.S. patents which the company took home in 2014. Including design and utility patents, Samsung has already taken in 2,017 U.S. patents since the beginning of 2016, an incredible pace which would blow past the firm’s 2015 totals if it holds up all year. 5G Mobile Networks: The Next Big Battleground

5G is expected to generate even higher revenues from applications and services due to explosion on mobile application and services because of broadband-like speed, which are crucial for some of the emerging technologies like IoT, Wearables and Virtual/Augmented Reality. Revenues for 5G services will exceed $65 billion by 2025, according to a forecast from Juniper Research… The number of patents and key underlying technologies for 5G mobile networks will evolve significantly within next 5 years. However, early analysis shows that Qualcomm will still be the IP leader but may be not as dominant as in 4G-LTE. Patent litigation report shows Samsung overtaking Apple as top defendant in 2015

2015 is the second straight year in which the list of top plaintiffs has been led by eDekka LLC, a patent holding company, which at times has been accused of exhibiting trolling behaviors… Atop this list was the U.S. District Court for the Northern District of California (N.D. Cal.), which between 2005 and 2015 has awarded more than $2.1 billion in compensatory damages over the course of 2,169 cases filed. Following behind them was the U.S. District for the Southern District of California (S.D. Cal.), U.S. District Court for the Southern District of New York (S.D.N.Y.), and followed in fourth place by E.D. Tex. Median damages for cases terminating between 2000 and 2015 showed a different story, however, as that list was topped by the District of Delaware, which had a median award of $10.46 million in 40 cases with damages. The Eastern District of Texas follows in second with a $7.68 million median damages award and in third is the U.S. District Court for the Eastern District of Virginia (E.D. Va.), with a median award of $2.98 million. After that, there’s a steep drop and every other district is showing a median damages award of less than $1 million.

Supremes take Samsung v. Apple design patents damages case

On Monday, March 21, 2016, the United States Supreme Court accepted certiorari in Samsung Electronics v. Apple, Inc., which relates to how much Samsung owes for infringing Apple design patents. The question accepted by the Supreme Court is: “Where a design patent is applied to only a component of a product, should an award of infringer’s profits be limited to those profits attributable to the component?”

Samsung world’s 2nd-most active patenting company, invents user authentication and wearable tech

In 2015, Samsung took home the second-greatest number of patents from the U.S. Patent and Trademark Office with 5,072 U.S. patents, which trailed only perennial patent giant IBM (NYSE:IBM) in terms of patents earned last year. That amount represents a slight uptick for Samsung from 2014, when the company took in 4,936 U.S. patents. Through the first month and a half of 2016, Samsung has earned 955 U.S. patents, a torrid pace of innovation that would easily eclipse Samsung’s 2015 patent totals if this pace holds. Will the Supreme Court Save Apple from Itself?

The victory, if it stands, will encourage more design patent infringement claims, and Apple will likely find itself defending against similar suits in the not so distant future. On December 14, Samsung filed a petition asking the Supreme Court to hear an appeal in the case. Given the economics of future litigation, Apple might quietly hope that the Court takes the opportunity to articulate the appropriate standard for awarding total profit damages for infringement.

IBM receives most U.S. patents for 23rd consecutive year

IBM once again has topped the list of annual U.S. patent recipients, receiving 7,355 patents in 2015. This is the 23rd consecutive year IBM has received more U.S. patents than any other entity in the world. More than 8,500 IBMers residing in 50 states and territories and 46 countries are responsible for IBM’s 2015 patent tally. IBM inventors who reside outside the U.S. contributed to more than 36 percent of the company’s 2015 patents.
