CLEPatents have been and continue to be an important asset for all innovators. Unfortunately, a patent is not an asset that typically possesses flexibility and adaptability. This makes “doing it right” from the outset of the utmost importance.

What does “doing it right” mean? What it means to “do it right” will be the focus of this panel conversation, but with a twist. This discussion will focus on creating a patent prosecution strategy to address the good, the bad, and the ugly as seen from those with different perspectives within the industry. Specifically, the panel will provide analysis and commentary from the perspective of both in-house and law firm patent practitioners. What are the landmines and pitfalls that can significantly undercut any particular patent asset, as well as an entire patent family?

Among other things, this panel will discuss:

(1) The good, bad, and ugly of patent prosecution, focusing on best practices for quality patents.

(2) Patent prosecution strategies to address the good, bad, and ugly.

(3) Drafting patent claims with assertion in mind, as well as the potential problems associated with seeking overly broad claims.

(4) Comparing and contrasting best practices for breakthrough innovations versus incremental improvements, including good, bad and ugly strategies for protecting important innovations.
