High Stakes Multinational Standard Essential Patent Litigation

Patent owners are increasingly considering more complex strategies when pursuing implementers. While traditional approaches often include domestic filings at the United States International Trade Commission (ITC), as well as a companion district court cases do considerably increase leverage, some patent owners are contemplating a worldwide enforcement campaign when stakes are particularly high.

Resorting to a full court press that leverages a variety of jurisdictions, including those that are frequently less sympathetic , if not openly hostile, to implementers’ charges of patent holdup can significantly influence the outcomes, but it comes with a cost in terms of financial outlay.

This panel will discuss navigating high stakes multinational SEP litigation from the perspective of both the patent owner and the implementer, who often times is also a patent owner themselves.
