How can patent practitioners safely use the power of Artificial Intelligence (AI) without compromising client confidentiality and/or proprietary information? And how do practitioners know whether a particular AI solution is secure, reliable, and accurate? And how do practitioners ensure that use of AI technology in patent practice is ethical and client electronic data and information is safe and secure?

The ethical concerns presented when using artificial intelligence are not insurmountable but do require practitioners to engage in serious forethought and consultation with clients prior to using these tools, specifically focusing on how to safeguard electronic information while using artificial intelligence tools, and how to protect confidential and proprietary information while still leveraging the power of AI tools. Therefore, it is essential for practitioners to know how AI tools will use and store the electronic data entered it AI systems, where the servers storing the electronic data and information are located, how the electronic data and information will be stored—including whether and how the information will be encrypted, whether any confidential or proprietary information entered will be leveraged by the AI tool for training purposes, and whether the AI tools used will store

To explore these questions and issues, the panel will discuss both ABA Model Rules of Professional Conduct and the USPTO Rules of Professional Conduct, particularly the rules relating to the protection of electronic data and information when using AI tools, including but not limited to rules relating to competence, diligence, communication with clients, obtaining informed consent, safeguarding client confidential information, duties of a supervising attorney, and more.
