Creating an Innovative Ecosystem to Drive Value
The concept of driving value in the patent context can mean many different things to different people. Conceptually, there is nothing new about the need for fiscal responsibility as a lead component in the value proposition. What is new, however, is what seems to be the sometimes-unrealistic expectations of the courts, which is diametrically inapposite to the often-indiscriminate cost-cutting measures imposed during times of economic downturn.
This panel will discuss the trials and tribulations facing innovators as they seek to cultivate, define, and protect as much innovation as possible without chasing (and maintaining) weak patents that only work to eat precious resources and divert attention from stronger innovation pathways. Among other things, the panel will also discuss:
(1) Designing an optimal in-house patent department, including structure and personnel decisions (i.e., patent attorneys vs. patent agents vs. patent engineers vs. data scientists vs. IP Managers).
(2) Collaboration opportunities between innovators, in-house patent counsel and outside lawyers throughout the various stages of the innovation to commercialization cycle.
(3) What mechanism can be put into place to streamline processes, cut costs, and simultaneously maintain focused protection on core technologies that have business relevance?
(4) How can and should innovators triage innovation and determine where to direct their time and limited financial resources?
(5) What functions innovators can outsource to outside lawyers and vendors versus what should be done in-house.
