Copyrights and Artificial Intelligence: The Battle Between Content Creators and AI Developers.*
Recently, Getty Images began legal proceedings in the High Court of Justice in London against Stability AI claiming Stability AI infringed intellectual property rights including copyright in content owned or represented by Getty Images. Getty asserts that Stability AI unlawfully copied and processed millions of images protected by copyright and the associated metadata owned or represented by Getty Images without a license and to the detriment of the content creators.
Meanwhile, a group of visual artists has sued artificial intelligence companies Stability AI Ltd, Midjourney Inc., and DeviantArt Inc. for copyright infringement, claiming that the software copies billions of copyrighted images to enable Midjourney and DeviantArt’s AI to create images in those artists’ styles without permission, according to the proposed class-action lawsuit filed recently filed in San Francisco federal court.
Microsoft, GitHub, and OpenAI are also seeking the dismissal of another proposed class action lawsuit that accuses the companies of scraping licensed code for the purpose of building GitHub’s AI-powered Copilot tool.
Whether it is the result of copying images, or scraping copyrighted works for the purpose of using those works or perhaps creating derivative works, there is no doubt that there is a fast emerging line of copyright disputes associated with the unauthorized use of copyright works and various artificial intelligence platforms.
This panel will discuss the recently filed copyright infringement actions, the alleged copyright infringement, whether the actions by AI developers constitute fair use, and the future of content creation in an increasingly artificial intelligence driven world.
