Coping with Alice: Strategies for Winning on Patent Eligibility *

CLEEver since the Supreme Court’s seminal decision in Alice Corp. v. CLS Bank Int’l, the law of subject matter eligibility for software patents has remained an enigma. While practitioners understand that abstract ideas, without more, are not patentable under 35 U.S.C. § 101, gleaning from relevant precedent whether a particular software patent will or will not pass muster under Alice remains a challenge.

In addition to discussing the wide differences between how district courts handle and interpret 101, the panel will also discuss strategies for winning on this all-important issue. Among other things, this panel will address:

  • How are district courts actually handling cases where software patents are litigated?
  • What are the latest Federal Circuit trends, and how are these latest pronouncements influencing district court proceedings and decision-making?
  • What lessons can be gained by innovators and patent practitioners who are preparing, filing, and prosecuting software patent applications?
