The AI Data Dilemma: Protecting Individuals While Empowering Platforms *
As artificial intelligence (AI) continues to reshape industries, it presents both groundbreaking opportunities and distinct challenge–for example, with regard to users’ data rights management and ownership. If a model is trained or fine-tuned using proprietary data, who owns the resulting parameters or architectural modifications? These improvements can represent valuable intellectual property, making it critical to define ownership and usage rights to ensure clarity and alignment between all parties involved. Furthermore, access to data does not necessarily equate to the right to use it for any purpose. Purpose limitations, consent, and adhering to users reasonable expectations and preferences are critical. Have explicit rights been granted to use the data for training AI models or deploying their outputs? Can the data or insights derived from it be shared, and under what conditions? What additional challenges and solutions exist in this space?
The panel will also explore the evolving intersection of data portability and AI. Data portability enhances user agency by enabling seamless and secure data transfers across services, fostering competition, innovation, and user choice. Yet, outstanding questions remain about how to properly distinguish between user data that is reasonable to promote user choice over–and data that should be excluded and protected– such as trade secrets, proprietary algorithms, and data affecting others’ privacy.
This panel will explore these and numerous opportunities, challenges, and outstanding questions at the intersection of data rights, privacy, ownership, licensing of rights, and the evolving role of data portability in AI.
