Paul Gugliuzza

Paul Gugliuzza holds the Thomas W. Gregory Professorship at The University of Texas at Austin School of Law. He is an expert on intellectual property law and civil procedure. His research focuses on patent law and litigation, with articles published in the Stanford Law Review, University of Pennsylvania Law Review, Virginia Law Review, and Duke Law Journal, among others. He has testified before the U.S. Senate and the U.S. House of Representatives, and his scholarship has been cited in over twenty judicial opinions. Before academia, he practiced in the Issues and Appeals group at Jones Day in Washington, D.C. and clerked for Judge Ronald Gould on the U.S. Court of Appeals for the Ninth Circuit.

Testing the Limits of State ‘Anti-Troll’ Laws

The U.S. Court of Appeals for the Federal Circuit on Monday heard oral argument in Micron Technology v. Longhorn IP, a test of state “anti-troll” statutes’ interplay with federal patent law. As inter partes review (IPR) becomes more and more difficult to obtain, those state statutes could play an important role in discouraging abusive patent enforcement—provided they are deemed to be constitutional.
