Webinar: The Continuing Evolution of Solid Form Patent Strategies in Pharmaceutical Development

Obtaining regulatory approval for small-molecule therapeutics continues to be an arduous and expensive process. Because composition of matter patents are often filed long before first-patient-in, that process can severely limit regulatory exclusivity. While patent term extension may help restore some of that exclusivity, the natural development process may provide additional avenues to create new composition of matter exclusivity opportunities – namely, through the introduction of follow-on solid form patents.

Patents covering solid forms such as salts and co-crystals may be deployed to provide their own exclusivity, which is different in scope than older “organic chemistry” composition of matter patents. This strategy might present an added benefit for many clients. As the impact of the Inflation Reduction Act (IRA) begins to ripple through the industry, this strategy may help ameliorate some of its negative consequences on small-molecule pharmaceutical development.
