Will Barker is an Associate with Parker Poe. He concentrates his practice on intellectual property transactions. He is part of a team that drafts and negotiates technology contracts and other commercial agreements, including confidentiality agreements, software license agreements, and data sharing agreements.

Will is an IAPP Certified Information Privacy Professional/Europe.

Will earned his law degree from Campbell University, where he was recognized as a Dean’s Excellence Academic Scholar. While in law school, Will was a member of the Lawyers & Leaders group and participated in several law-related internships. He earned his bachelor’s degree from the University of North Carolina at Chapel Hill.

Outside of work, Will can be found volunteering with his church, working on his family farm, or developing his leadership skills through the New City Fellows program.

Licensor Beware: Copyright Protections in Peril

Companies rely on copyright protections to shield their software, data sets, and other works that are licensed to their customers; however, a reframing of what constitutes a “transformative use,” and the extent a license can restrict such fair uses, may whittle away all avenues of protections. On October 22, 2022, the Supreme Court of the United States heard arguments for Andy Warhol Foundation v. Goldsmith. The question before the Court is where does a copyright holder’s right to create derivative works stop and “fair use” of the work begin? Companies that license data sets or data feeds should pay close attention, as the Court’s decision could narrow contractual remedies.
