Hannah Follender

Intellectual Property Attorney

Hannah Follender is an intellectual property attorney specializing in trademark prosecution and enforcement, copyright protection, and patent prosecution. Hannah founded and currently co-chairs the Cannabis Law Section of the Utah State Bar. Hannah became a patent agent in 2017, and received her J.D. from the S.J. Quinney College of Law at the University of Utah in 2018 and was awarded the Outstanding Achievement Award for patent law. Hannah received her B.S. cum laude from St. Lawrence University in 2011. Between college and law school, Hannah spent a period of time as a professional extreme skier, competing on the Freeskiing World Tour throughout the Americas. In her free time, Hannah is a certified avalanche course instructor for AIARE and teaches avalanche education and ski guides in the Wasatch Mountains of Utah.

Win for Photographer in Ninth Circuit Reversal of Fair Use Finding

On August 3, the U.S. Court of Appeals for the Ninth Circuit issued a ruling in McGucken v. Pub Ocean Ltd. that reversed a Central District of California’s sua sponte grant of summary judgment to Pub Ocean on McGucken’s copyright infringement claims. The case involved Pub Ocean’s unauthorized use of photos of a lake that formed in Death Valley, California, in March 2019. The Ninth Circuit found that all of the fair use factors weighed against a determination that Pub Ocean’s unlicensed use of the photographs were transformative.
