Patent Filings Roundup: PTAB Denies Lash Company PGR over ITC Investigation Given Fintiv; DuoLingo Files Declaratory Judgment Against Prolific Filer

Weekly patent filings have settled into a roughly 60-complaint, 30-petition trend this year, and this week was no different; the district court saw a handful of new LLCs sharing the same Delaware address, a slew of additions to existing campaigns, and another Acacia campaign launched, Atlas Global Technologies LLC. The Hilco entities, Rothschild entities, and DynaIP have all added a number of new defendants. Take a look.

PTAB Lashes Out: In another Fintiv denial in light of an International Trade Commission (ITC) investigation, the Patent Trial and Appeal Board (PTAB) denied Post Grant Review (PGR) No. 2021-00046, filed by Kiss Nail Products, Inc., against rival company Lashify, Inc. Apparently, there was a parallel ITC case where the initial decision had issued and the completion date would have been before the final written decision; the Board gave no weight to the fact that the ITC lacks the statutory power to cancel patent claims, instead relying on the reasoning of the precedential Fintiv case itself. The patent is 10,721,984; the petition was, quite obviously, filed withing months of the patenting issuing.

DuoLingo Files DJ of Noninfringement Against Frequent Filer Modern Font: In what will be the 22nd suit provoked by Modern Font Applications LLC’s letter and assertion campaign, the free language learning application DuoLingo has lawyered up (with Latham & Watkins, no less) and filed a declaratory judgment action of noninfringement, alleging they received a threat letter and do not infringe. The three patents, U.S. 9,886, 8,522,127, and 9,892,093, all cover various aspects of using or modifying available fonts or lists of fonts in messaging or operating systems. This marks at least 20 known app or website makers who have been sued or threatened with suit in the relatively recent campaign.
