George is the Senior Intellectual Property Counsel for Volvo Car Corporation where he is responsible for prosecution, IP licensing and IP litigation in the US. During twenty-five year career in IP Management, Strategy, Licensing and Patent law, he has been responsible for IP department mentoring and training activities at several multi-national tech firms, including at Qualcomm and Motorola where he previously held roles as VP of Patents and Senior Patent Counsel, respectively. George has substantial experience in the assertion of patents before various appeals bodies of national patent offices, both in the US and EU, and examination-relevant experience in the valuation and commercialization of patent portfolios. He has also been involved in the commercialization of patents and knowhow at universities and research centers, as well as the monetization of patent assets owned by small, medium and large size corporations worldwide. Patent strengthening is the term that refers to the process of achieving the greatest potential for value from a patent during the prosecution – before a patent is even granted.

Events along the way during patent prosecution create multiple windows of opportunity for a patent, and therefore a portfolio, to be strengthened. Of course, the converse is also true. Patent prosecution provides strategic opportunities, but at the same time merely pushing paper and returning service to a patent examiner without thoughtful consideration can spell disaster.

At a high level, there are four factors to consider:

  • Adoption of the innovation in the marketplace
  • Identifying additional innovations to pursue
  • Tuning applications to a company of interest
  • Abandoning applications with concerns to conserve resources
